Wealthy Kings Point Sassouni Family Sued for Fraud

            Kings Point, New York (July 13, 2015) — Last Wednesday, the Law Offices of David Yerushalmi, P.C., filed a lawsuit on behalf of Greek-American businessman, Photios Cougentakis, alleging that Sayeh Sassouni, who lives at 34 Hemlock Drive in Kings Point, conspired with her father and mother, Nejatollah and Susan Sassouni, also Kings Point residents, to fraudulently convey her home to avoid foreclosure.  The lawsuit, entitled Photios Cougentakis v. Sayeh Sassuoni, TOLA New York Enterprises Inc., Nejatollah Sassouni, and Susan Sassouni, et al., Index No. 604439, was filed in the Commercial Division of the Supreme Court of Nassau County on July 8, 2015.

            According to the verified complaint initiating the lawsuit, in 2006, ESB had initiated court proceedings against Sayeh Sassouni to foreclose on her home in Kings Point.  The Cougentakis complaint further alleges that Sayeh Sassouni conspired with her father Nejatollah to take over ESB’s position and to have Nejatollah, through a front-company (TOLA New York Enterprises), “foreclose” on his daughter for a mere $100, thereby wiping out the $2 million Cougentakis mortgage.  However, Sayeh and her family continued to live at the Kings Point residence rent-free and do so today. 

            The lawsuit requests the court enter a judgment in the amount of the $3.9 million now owed on the promissory note and impose a statutory and equitable lien on the Kings Point property because Nejatollah Sassouni’s foreclosure was a sham and illegal fraudulent conveyance.

            According to the allegations in the verified complaint, Sayeh Sassouni has accumulated judgments worth hundreds of thousands of dollars against her for bad debts beyond the nearly $4 million claimed in this lawsuit.  In fact, in a separate lawsuit, Shahriar Homapour, another Kings Point resident, obtained a judgment against Sayeh Sassouni for close to $300,000 for monies she borrowed and promised to pay back but did not.  Homapour’s lawyer successfully obtained a court order requiring Sayeh’s 85-year-old father to testify at a post-judgment deposition explaining exactly how he came to own Sayeh’s home at 34 Hemlock while she and her husband, Vahid Khorshad, continue to live there.
